The following Terms & Conditions are applicable for purchases made via this website. Purchases made via our eBay store (FSHOP AUSTRALIA) are subject to a different set of Terms & Conditions. 1. Definitions

1.1 In these Terms and Conditions the following terms shall have the meanings set out below:

• ACL means the Australian Consumer Law which is contained in Schedule 2 of the Competition and Consumer Act 2010(Cth).
• Completed Order Notification means a written notice that we have accepted the Purchase Order and that the Goods have been dispatched.
• Contract means the Terms and Conditions for a Purchase Order and Purchase Order Acknowledgement.
• Customer means the individual or entity as detailed on the Purchase order.
• fshop means the legal entity trading under that name and any related body corporate (within the meaning of section 50 of the Corporation Act 2001(Cth)) as specified in the Purchase Order.
• Delivery Confirmation means a valid proof of delivery by an courier or delivery agent for the Goods.
• Goods means any goods, products, services or materials supplied or to be supplied by fshop
• GST means any goods and services tax imposed on the Goods pursuant to the GST Law.
• GST Law means A New Tax System(Goods and Services Tax) ACT 1999(Cth).
• Purchase Order means an order or offer to purchase Goods from Our Website.
• Purchase Order Acknowledgement is defined under clause 2.1(a).
• Terms and Conditions means the terms and conditions set out in this documents and as modified or amended in relation to particular Purchase Order.
• Our Website means fshop.com.au

2. Binding Terms & Conditions

2.1 Purchase Order, Purchase Order Acknowledgement and Terms and Conditions

• A Purchase Order or an offer to purchase can be made by the Customer using Our Website, however the Customer agrees that the Purchase Order and Contract shall only be deemed to have been accepted when the Customer receives a Completed Order Notification or when Delivery Confirmation of the relevant Goods has been provided, whichever first occurs (“Purchase Order Acknowledgement”).
• Purchase Orders are subject to manual review prior to being accepted. For the avoidance of doubt, payment in full does not guarantee an acceptance of the Purchase Order and does not constitute a Purchase Order Acknowledgement.
• The Terms and Conditions apply to every Purchase Order, unless otherwise agreed in writing by fshop.
• By submitting a Purchase Order on Our Website, the Customer hereby accepts and agrees to be bound by the Terms and Conditions.

3. Payment & Credit Vouchers

Payments are processed in Australian dollars (AUD) using a secure checkout. For security reasons we do not save your credit card details.

To be eligible to use a credit voucher offered by us you must make a purchase via fshop.com.au using the same email address that the offer was sent to before the voucher expiry date.

Vouchers are not transferable and cannot be be redeemed for cash.

Customers will be ineligible to use a voucher if their account is inaccessible or suspended for any reason.

4. Shipping - General information

In the event that an item gets returned to us as 'refused' or 'uncollected' we reserve the right to treat it as a 'change of mind return' and issue a refund in accordance with our returns policy.

5. Shipping within Australia

Standard shipping with Australia Post usually takes 2-6 business days. Additional time may be required for delivery to NT and WA.

Express shipping with Australia Post eParcel is a non guaranteed next day delivery service that requires signature on delivery.

6. Shipping Internationally

Express shipping is available to most countries. This is the quickest and most reliable way to track and receive your goods.

International customers are responsible for any customs fees or taxes that are associated with the importation of the goods.

7. Returns – Change of mind

Unless stated otherwise, we will provide you with an exchange or a refund provided that:

• you return the item within 30 days of purchase; and
• the item is in it original condition with all of the packaging.

A $15 restocking fee will be charged on items that are being returned for a refund.

8. Returns – Consumer Guarantees

The Australian Consumer Law protects consumers by giving them certain guarantees when they buy goods and services. These are known as “Consumer Guarantees”. For further information, please refer to the Australian Competition and Consumer Commission website.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
